Why it’s on the record. On Sept. 21, 2020, the first Senate day after Ginsburg died, McConnell told the floor: 'President Trump's nominee for this vacancy will receive a vote on the floor of the Senate.' Barrett was confirmed on Oct. 26, 2020, while ballots were already being cast. Trump lost eight days later, so he was the president on the way out the door.

McConnell was explaining why the Senate would not consider Merrick Garland. He said the 'principle' was that the president being elected should fill the seat.
